The Finance Minister in his budget speech for the Union Budget 2015-16 interalia stressed the need to streamline the institutional arrangements for resolution of disputes relating to public contracts and proposed to introduce Public Contracts (Resolution of Disputes) Bill. The relevant excerpt from his budget speech is as follows:

"73. On the other hand, disputes arising in public contracts take long to resolve, and the process is very costly too. My Government proposes to introduce Public Contracts (Resolution of Disputes) Bill, to streamline the institutional arrangements for resolution of such disputes."

2. Accordingly, a preliminary first draft of Public Contracts (Resolution of Disputes) Bill, 2015 has been prepared. The proposed legislation is envisaged to deal with the contracts entered into by Public Authority for construction projects and infrastructure projects including PPP projects.

3. The draft bill is attached for obtaining comments/views of stakeholders.

So a better sub contractor is sided and cheaper Contracter is appointed. 1.syphoning of funds from this contract bills to other places and not paying the vendors and sub contractor. 2.sub contractor and vendor delay the projects by not receiving there dues. 3.this leads To delay in payment by subcontractors to labours and there vendors.. Thus the project gets delayed by one of the reason.while drafting act kindly consider this points.

In continuation to my comment.the contractor engages a sub contractors without getting in to details about his company profile or he is following all the norms of the land or he is registered with all the concern departments .like(epf,ESI, bocw etc). The mindset of main contractor is to maximise the profit by engaging a sub contractors who can give them better price. There the prb arises a person who is following all norms can't give better prices than person who doesn't oblige to all norms.

The fundamental issue is in contracts is sub contracts- THE SUBCONTRACTS OR LETTING THE JOB TO SPECILIZED SUB CONTRACT OF PARTICULAR JOB WHICH FALLS IN THE CONTRACTS. THE ISSUE IS THE PRINCIPLE COMPANY WHO ENGAGES CONTRACTER RECEIVES ALL THE CREDENTIALS OF THE CONTRACTS AND AWARD CONTRACT AS PER THE TENDER PROCESS. NOW WHEN THE CONTRACTOR APPOINTS SUB CONTRACTOR. THE CREDENTIALS OF THAT CONTRACTOR IS NOT CHECKED BY THE PRINCIPLE CLIENT BECAUSE HE THINKS IT IS NOT HIS JOB.

The gov of india says that they issue passport in just 1 month. But still i didnt got my passport after 8 months has been passed away.There is no reply from RPO Ahmedabad gujarat. Is this our good governance? Is this way india want be number one? y

माननीय प्रधानमंत्री जी आज हम लोगो के सामने सबसे बरी समस्या है क़ि जो लोग भी सरकारी सेवा में है उनका समय से ऑफिस नहीं पहुचना। चाहे स्कूल हो चाहे अस्पताल हो तहसील हो या कोई भी सरकारी ऑफिस कही पर भी समय से नहीं मिलते है लोग। गावों की तो और भी बुरी हालत है। इस हालत में सबसे पहली जरुरत है की सभी राज्यों में जीपीय्स आधारित attendence सिस्टम लागू किया जाये। एक साल आप सभी राज्यों को इसी लिए बजट दीजिये और कहिये की अगर आप अपने राज्यों में ये सिस्टम नहीं लगायेंगे तो केंद्र से कोई मदद नहीं मिलेगी। जय भारत।

Where public contracts have more disputes this could be a great step towards achieving the faster economic growth and transparency..welcome step.

The execution of contract should be executed without doing loss to any party. The fulfillment of contract with specific quality and within time is responsiblility of contractor, while payment for contract within time is duty of owner. The problem created for quality,time and payment,it should be time bound resolved by arbitrating authority with transparacy on CCTV camara, so, that NO body should bear loss or if actual loss, it should be gennuine and ability, capacity to bear such loss pleasurly

युवाओ में अजीब उलझन इस दौर में है। उन्हें सही दिशा देने के लिए रोजगार उन्मुखी शिक्षा को माध्यमिक शिक्षा से जोड़ा जाना चाहिए।

Sir just like public grievance portal of DOPT there should be a portal to give suggestion to all dept. This will be very helpful and can save huge govt money from misuse.
